Central Ohio Homebuyers, You Could be on Camera

Central Ohio home buyers videoSellers have had the upper hand for an extended period of time, due to persistently low home inventory. But there is another advantage sellers may have: the right to video record a buyer’s every move while touring the home. In fact, a seller could be watching you via live video streaming on their smartphone!

Unless you have a good poker face, a seller using cameras will know exactly how you feel about their home. If you look too excited, they could use this knowledge to drive a hard bargain. If you sneer at their décor, they’ll know this too, and possibly refuse your offer.

Ohio law permits homeowners to use surveillance video during home showings, with few limitations. For example, cameras may not be used in areas where there is a “reasonable expectation of privacy,” such as a washroom. Another limitation is the use of audio recording. In Ohio, at least one of the people being audio recorded must give consent.

This can get sticky. Imagine if the agent knows about the use of audio recording, but you do not! Technically, if the agent who is with you knows about the audio recording, the seller is within the law because at least one of the people being recorded (not you, in this case) knew about it.

In practice, listing agents are encouraged to disclose the use of cameras in a property, and obtain written consent from any visitors to the home. This is because Ohio law also has consequences for audio recordings conducted without consent.

Yet home sellers are rarely legal experts. Sellers wish to protect their home and belongings during showings, and monitoring visitors gives them some comfort. Sellers may not be aware of any legal limitations, and therefore, may not even disclose the use of surveillance equipment to their own agent.

As a Central Ohio home buyer, it is best to assume that video and audio surveillance equipment may be in use in any home you tour. Certainly, you should ask questions about the home during your tour of the property, but save your opinions until you’re off the grounds.
